Domestic Violence Act Proceedings Civil In Nature Except When Protection/interim Order Is Breached

Domestic violence is not just physical violence alone. Domestic violence is said to be any behavior the purpose of which is to gain power and control over a spouse, partner, or intimate family member. Abuse is certainly a learned behavior; it is not caused by anger, mental problems, drugs or alcohol, or other common excuses. There are several kinds of domestic violence exhibited. Domestic violence is a social evil and it takes place in several forms. It is said to be a coercive form of violence and women are globally subjected to the different forms of violence.

  • Biological and psychological abuse with regard to change in the mental and physical differences between men and women
  • Social and personal stress
  • Conflict of opinion

However, in several instances, women have been seen taking benefit of the legislation availed to them, in order to satisfy their due interests and to come out of the marriages and the legal consequences.

If someone, being the aggrieved person, have reason to believe that an act of domestic violence has been committed or is being committed or is likely to be committed, that person may give information about it to the concerned Protection Officer. One may so inform the Protection Officer of the concerned area either orally or in writing. An aggrieved person, may even inform Service providers. As to who are service providers, the Act provides that a registered voluntary association or a registered company, whose objective is to protect rights and interests of women by lawful means, shall be the Service providers. Protection Officer is an Officer appointed by the State Government in each district in order to make sure that the procedures are carried out in the expected way.
